This Agreement is between the Undersigned (and any minor I am signing on behalf of) and Hurricane Ridge Winter Sports Education Foundation (“Foundation”). This Agreement pertains to the use of Hurricane Ridge Ski Area in any form. I agree to the following Waiver, Indemnity, and Assumption of Risk Agreement as a condition for the services offered by the Foundation, which includes access to skiing, snowboarding, tubing, lessons, use of surface lifts, rope tows, tubing equipment, and first aid provided by a ski patrol. I agree not to use any of these services if I am unwilling to agree to every term in this Agreement. Winter sports including skiing, snowboarding, tubing, lessons, and all other forms of snow related recreation come with inherent, unavoidable, and high risks including serious injury, paralysis, traumatic brain injury, or death. I have taken the time to educate myself with these risks including but not limited to considering lessons, reviewing the trail map, reviewing the Foundation’s website (https://www.hurricaneridge.com/), reviewing the weather forecast, and equipping myself with functional equipment, for which I am familiar. I accept and expressly ASSUME ALL RISKS associated with winter sports including but not limited to: Falling; collisions and entanglements with other people, who may be out of control, and objects (man-made and natural); avalanches (in bounds and out of bounds), which cannot be mitigated per the Foundation’s permit with the National Park; deep snow immersion, cornices; crevasses; equipment failure and malfunction; equipment damage; negligent selection or binding setting and/or maintenance of the rental equipment; improper use of rental equipment; becoming inverted; failure to maintain or otherwise upkeep my own equipment; slick or uneven surfaces inside and outside; slipping; tripping; loss of balance; changing weather conditions; existing and changing snow conditions; unexpected sub-surface conditions, including objects hidden under snow; bare spots; rugged mountainous terrain; bumps; stumps, trees and other forest growth; tree wells, which could result in suffocation; downed timber; rocks of various sizes; holes; debris; marked and unmarked obstacles; grooming and other equipment on the slopes; use of lifts and rope tows; drainage channels; variations in terrain; varying visibility; unmaintained trails; path and/or trail obstructions; unmarked roads and/or trails; terrain park accidents; other people acting in a negligent manner; failure to comply with signage; inadequate or negligent warning or instruction from Foundation employees; encounters with snowmobiles and/or other motor vehicles; becoming lost or separated; ski patrol / first aid response; ski area closure; lack of shelter; rope tow and surface lift loading, unloading, and riding; storms, lightning, hail, snow and other adverse weather; limited access to and/or delay of medical attention; fatigue; exhaustion; dehydration; hypothermia; altitude sickness; terrain park accidents; frostbite; & mental distress. I further acknowledge that the Foundation offers a unique winters sports environment as compared to some other ski areas, and that use of rope tows and surface lifts require increased attention and features a higher level of skill and risk, and I considered this and declare I am sufficiently experienced to use them. I acknowledge that the ski area parking lot is at the top, and if I miss the closing time I must hike up on my own and pay fees and penalties. I agree to only participate in winter sports based on my individualized ability. I had the opportunity to familiarize myself with RCW 79A.45. I agree to all the standards of conduct within RCW 7A.45.030. I will always maintain control of my speed and course. I voluntarily agree to RELEASE, DEFEND, INDEMNIFY and HOLD HARMLESS THE FOUNDATION and OLYMPIC NATIONAL PARK, its owners, land owners, directors and officers, employees, sponsors, volunteers, and agents, as well as the Hurricane Ridge volunteers, any contractors, vendors, equipment manufacturers and distributors, and program providers (“Released Parties”) from any and all claims, actions, or lawsuits related in any way to my activities at the Hurricane Ridge Ski Area, including but not limited to any and all claims or lawsuits for personal injury, including but not limited to paralysis, traumatic brain injury, and death. I AGREE NOT TO SUE THE RELEASED PARTIES. I AGREE TO DEFEND AND INDEMNIFY THE RELEASED PARTIES. I agree to pay all legal fees and costs incurred by the Released Parties which may arise from any claims, actions, or lawsuits by or on behalf of myself, any minor that I am signing on behalf of, my heirs, executors, administrators, and/or legal guardians or custodians. I will satisfy any judgment entered against or settlement reached by the Released Parties. This Agreement shall be construed broadly to provide THE RELEASE OF LIABILITY AND INDEMNIFICATION of the Released Parties to the maximum extent permissible. This Agreement is governed by the laws of the State of Washington. The venue for all disputes shall be Clallam County Washington. The undersigned further waives liability of the United States and acknowledges and agrees that the United States and its officers and employees are fully released from any liability for injuries, damages, or losses that the undersigned sustains as a result of or in connection with the undersigned’s participation in this activity. I accept that if any provision of this Agreement is held in whole or in part to be unenforceable for any reason, the remainder of that provision and of this entire Agreement will be severable and remain in effect. I declare that I agree to everything contained within this Agreement, that I am over the age of 18, and competent to enter into this Agreement in exchange for my ability to enjoy the use of Hurricane Ridge Ski Area. This Agreement is valid for the entirety of the 2026-2027 season and applies to all of my use of the Hurricane Ridge Ski Area. PARENT / LEGAL GUARDIAN SIGNING FOR MINOR Having legal capacity to do so, I agree to inform the minor named below of the terms of this Agreement and further agree that the minor will not use the services offered by the Foundation unless the minor named in this Agreement also accepts the responsibilities, risks, hazards, dangers, terms, and policies outlined in this Agreement, which I have explained to the minor. Use of Foundation services signifies both the legal guardian and the minor’s acceptance of this Agreement. I agree to RELASE, DEFEND, INDEMNIFY, and HOLD HARMLESS the Released Parties from any claims, actions, or lawsuits by or on behalf of the minor named below arising from their activities at the Hurricane Ridge Ski Area, including but not limited to any and all claims or lawsuits for personal injury, including but not limited to paralysis, traumatic brain injury, and death.
